Status of file as of April 19, 2024

Status of file as of February 23, 2024

On February 15, 2024, the Superior Court of Quebec issued a Eighth Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. et al. until April 19, 2024. Status of file as of December 21, 2023

On December 21, 2023, the Superior Court of Quebec issued a Seventh Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. et al. until February 16, 2024. Status of file as of September 25, 2023

On September 25, 2023, the Superior Court of Quebec issued three approval and vesting orders authorizing the sales of several assets related to the General SISP as well as an order relating to a dispute for the Ottawa project. Status of file as of August 31, 2023

On August 31, 2023, the Superior Court of Quebec issued an order extending the stay period against Groupe Sélection Inc. et al. until October 31, 2023. On the same day, the Court also issued an approval and vesting order authorizing the sales of certain assets related to the Rimouski project. Status of file as of August 18, 2023

On August 18, 2023, the Superior Court of Quebec issued an Approval and Vesting Order authorizing the sale transaction for the Rosemont project assets. The same day, Raymond Chabot Inc. (Dominic Deslandes,CPA, CIRP, LIT) was appointed Receiver of the Société en Commandite Résidence Valleyfield property. We refer you to the orders dated August 18, 2023 for further information.

Status of file as of August 04, 2023

On August 4, 2023, the Superior Court of Quebec issued two Approval and Vesting Orders authorizing sale transactions for certain assets of the District des Brasseurs project (or Molson Project) as well as for the Espace Montmorency Hôtel project. Status of file as of July 05, 2023

On July 5, 2023, the Superior Court of Quebec issued a Reverse Vesting Order authorizing a sale transaction for the assets of the Revera portfolio, as well as a Cancellation Order relating to said transaction. We refer you to the orders dated July 5, 2023 for further information.

Status of file as of June 21, 2023

On June 21, 2023, the Superior Court of Quebec issued an order extending the stay period against Groupe Sélection Inc. et al. until August 31, 2023 and authorizing the inclusion of certain assets in the Sale and Investment Sollicitation Process (“SISP”). Status of file as of May 16, 2023

On May 15, 2023, the Superior Court of Quebec issued an order partially lifting the stay of proceedings to allow for the exercise of certain rights and remedies for certain creditors. We refer you to the Order dated May 15, 2023 for more information.

Status of file as of May 5, 2023

On May 2, 2023, the Superior Court of Quebec issued an approval and vesting order authorizing the sales of certain assets related to project Espace Montmorency. We refer you to Approval and Vesting Order dated May 2, 2023 for further information.

On the same date, the Court also issued an order partially lifting the stay of proceedings to allow for the exercise of certain rights and remedies in relation to the agreements in place in the Clyde and Baseline project, authorizing the assignment of certain contracts and the payment of construction expenses. On May 3, 2023, the Superior Court of Quebec issued a rectified version of the Approval and Vesting Order issued on March 7, 2023. We refer you to the Rectified Approval and Vesting Order dated May 3, 2023 for more information.

Status of file as of May 1, 2023

On April 28, 2023, the Superior Court of Quebec issued a Sixth Amended and Restated Initial Order, partially lifting the stay of proceedings for creditors holding a legal hypotec in order to allow them to send and publish a notice of the exercise of a hypothecary right, which shall produce solely conservatory effects. We refer you to the Sixth Amended and Restated Initial Order dated April 28, 2023 for further information.

On the same day, the Court also issued an Order setting a claim process for the Creditors holding a legal hypotec on certain construction projects of Groupe Sélection. Status of file as of April 7, 2023

On April 7, 2023, the Superior Court of Quebec issued an order authorizing an Sale and Investment Solicitation Process with a Stalking Horse Bid (« Stalking Horse SISP ») for certain assets of Groupe Sélection in accordance with the terms and conditions set out in the document entitled « Procedures for the Stalking Horse Sale and Investment Solicitation Process ». Status of file as of March 21, 2023

On March 17, 2023, the Superior Court of Quebec issued a Fifth Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. et al. until June 22, 2023. We refer you to the Fifth Amended and Restated Initial Order dated March 17, 2023 for further information.

Status of file as of February 22, 2023

On February 22, 2023, the Superior Court of Quebec issued a Third Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. et al. until March 22, 2023. We refer you to the Third Amended and Restated Initial Order dated February 22, 2023 for further information.

Status of file as of December 22, 2022

On December 21st, 2022, the Superior Court of Quebec issued a Second Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. and al. until February 22nd, 2023. We refer you to the Second Amended and Restated Initial Order dated December 21st, 2022 for further information.

On the same day, the Court authorized the filing of a redacted First Report of the Proposed Monitor on the Business and Financial Affairs of the Debtor Companies, which had been initially filed under seal. Said report in now available in the Monitor’s Report section of this website.

We also wish to advise you that on December 14, 2022, an application was filed with the Court by CAFO Inc. and that the hearing in respect thereof is scheduled for January 9, 2023. Status of file as of December 2, 2022 

On December 1st, 2022, the Superior Court of Quebec issued an Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. and al. until December 21st, 2022. We refer you to the Amended and Restated Initial Order dated December 1st, 2022 for further information.

Status of file as of November 28, 2022 

An application for leave to appeal of the Initial Order rendered on November 21, 2022 was filed on November 22, 2022 together with an application for a stay of the provisional execution of the Initial Order. On November 28, 2022, the Court of Appeal of Quebec issued a judgment dismissing the application for leave to appeal and, consequently, also dismissing the application for a stay of provisional execution.

Status of file as of November 21, 2022 

An initial order pursuant to the Companies’ Creditors Arrangement Act (“CCAA”) was rendered on November 21, 2022 by the Superior Court of Québec with respect to Groupe Sélection Inc. et al. (the “Initial Order”).

We refer you to Appendix A of the Initial Order available on the Monitor’s website for the list of the debtors included in this proceeding and to Appendix B for a list of the limited partnerships impleaded in the proceedings (collectively the “CCAA Parties”).

The Initial order provides for an initial stay of all proceedings against the CCAA Parties as well as their respective directors and officers until December 1, 2022 and appoints PricewaterhouseCoopers Inc. (Christian Bourque, CPA, CIRP, LIT) as Monitor of the business and financial affairs of the CCAA Parties. All proceedings against the CCAA Parties and their directors and officers are suspended as of November 14, 2022 pursuant to an interim order issued that day (the “Interim Order”).
