Status of the file as at July 8, 2009

On July 7, 2009, the Court approved an order authorizing the Trustee to divest its right, title and interest in and to the Mill effective upon the registration of a notice of dissolution by owner by the Land Registrar for the Land Registry Office of Thunder Bay upon title to the Mill and ordering that any and all claims against the Trustee arising out of or in any way connected with the Mill be stayed, barred and forever extinguished.

Status of the file as at March 24, 2009

On March 24, 2009, the Trustee mailed to all known creditors including employees, the Notice of Bankruptcy and First Meeting of Creditors (the "Notice") advising the creditors that the first meeting of creditors will be held on April 7, 2009 at 2:00 p.m., at Royal Canadian Legion Branch 183 Hall, 39 Howe Street, Marathon, Ontario. A proof of claim form and general form of proxy, together with information relating to the bankruptcy were also mailed with the Notice. On the same day, all employees were mailed correspondence relating to the Wage Earner's Protection Program Act. Copies of all documents mailed can be found below. 

Status of the file as at March 17, 2009

On March 17, 2008, Marathon Pulp Inc. ("Marathon") failed to file a proposal with PricewaterhouseCoopers Inc. ("PwC") the proposal trustee (the "Trustee"), within the period of 30 days after the day on which the notice of intention was filed. As a consequence, of the failure to file the proposal, Marathon is deemed to have made an assignment pursuant to subsection 50.4 (8) of the Bankruptcy and Insolvency Act.

Particulars of the Meeting of Creditors and the Trustee's Preliminary Report to the Creditors will be posted on this website within the next two weeks.

Status of the file as at February 17, 2009

On February 17, 2009, the Trustee mailed a copy of the Notice to Creditors to all known creditors of Marathon pursuant to the provisions of the BIA.

Status of the file as at February 13, 2009

Take notice that on February 13, 2009 Marathon filed a Notice of Intention to Make a Proposal ("NOI") pursuant to Section 50.4(1) of the Bankruptcy and Insolvency Act (Canada) and PricewaterhouseCoopers Inc. was named as trustee (the "Trustee") under the NOI.

The Trustee will shortly be mailing a copy of the NOI to all known creditors of Marathon pursuant to the provisions of the BIA.

Wage Earner Protection Program Act:
In accordance with paragraph 21 (d) of the Wage Earner Protection Program Act (Canada) ("WEPPA"), PricewaterhouseCoopers Inc., in its capacity as trustee in bankruptcy of Marathon is required to advise all former employees of Marathon of the existence of the Wage Earner Protection Program enacted by WEPPA.
