A team of PwC Ukraine successfully supported its client, a global producer of HVAC and industrial equipment, in a dispute with Customs.
The customs agency made several decisions that resulted in reassignment of customs codes of the products imported by our Client on a permanent basis. The Agency’s actions resulted in a significant increase in customs duty payable by the Client. PwC team comprised of Andrey Pronchenko (Managing Partner at PwC Legal), Zhanna Brazhnyk (Attorney-at-Law, Head of Tax Disputes Resolution Practice at PwC Legal), Denis Shendryk (Head of Customs Practice at PwC), Oksana Drozach (Senior Consultant of Customs Practice at PwC) and Alexey Vorobiov (Senior Consultant of Customs Practice at PwC) advised the Client on strategy in the case and provided legal support during the administrative appeal of the customs agency’s decisions.
The PwC Ukraine team performed technical analysis of the imported goods for the purposes of assigning appropriate customs codes, based on which, respective complaints and motions were prepared and filed. The team also provided advice on evidence admissibility and represented the Client during the hearings. As an outcome of the administrative pre-trial procedure, the State Fiscal Service of Ukraine set aside in part (the most material part) the decisions of the customs agency.
