Status of File as of February 28, 2023

On February 22, 2023 the Receiver's Certificate - Discharge was filed with the Winnipeg Court Centre. A copy of the Receiver's Certificate and the Ninth (an Final) Interim Report of the Receiver pursuant to Subsection 246(3) of the Bankruptcy and Insolvency Act may be located in the "Receiver Discharge" folder of this website.

Status of File as of January 12, 2022

On January 12, 2022 an order was granted by the Court approving the settlement agreement with Accel Construction Ltd., the conduct and activities of the Receiver, and the discharge of PricewaterhouseCoopers Inc. as Receiver of 390 Assiniboine Ave Inc. upon the completion of certain administrative matters and filing of a Receiver's Certificate. A copy of the Settlement Approval and Discharge Order is included in the Court Orders tab of the website.

Status of File as of January 6, 2022

On January 6, 2022, the Receiver filed its Seventh and Final Report to inform the Court of the Receiver’s activities since completion of the Sixth Report dated July 28, 2021 and to seek approval of the settlement agreement with Accel Construction Ltd., distribution of remaining funds, and discharge of PricewaterhouseCoopers Inc. as Receiver of 390 Assiniboine Ave Inc.. The application will be heard on January 12, 2022.

Status of File as of September 1, 2021

On August 31, 2021, the sale of the company’s real property closed as approved by the Court on August 4, 2021. A copy of the final Approval and Vesting Order is included in the Court Materials tab of the website (under Court Orders).

Status of file as of August 4, 2021

On August 4, 2021, an order was granted by the Court approving the conduct and activities of the Receiver, the sale of the company's real property and sealing the Confidential Supplement to Receiver’s Sixth Report (the “Approval and Vesting Order”). 

A copy of the draft order is included in the Court Materials tab of the website (under Notice of Motion). The final Approval and Vesting Order (with minor modifications from the draft form of order) will be posted to the website as soon as it becomes available from the Court. 

The sale is expected to close as soon as reasonably possible, after the final Approval and Vesting Order is issued by the Court.

Status of file as of July 28, 2021

On July 28, 2021, the Receiver filed its Sixth Report to inform the Court of the Receiver’s activities since its appointment and to seek approval of the sale of the Company’s real property.  The application will be heard on August 4, 2021.

Status of file as of February 10, 2017

On February 10, 2017 PricewaterhouseCoopers Inc. was appointed Receiver of 390 Assiniboine Ave. Inc. by The Court of Queen’s Bench of Manitoba.
