Key considerations for the technical requirements in processing sensitive data, including genetic and biometric data

With the enactment of the Personal Data Protection Law ("PDPL") in 2021, Mongolia introduced several advanced and novel legal concepts in the realm of data protection. Notably, the PDPL categorizes personal data based on its nature into various types, including sensitive, confidential, biometric, and genetic information. It also imposes restrictions on the use of such data and requires data controllers to comply with more stringent legal requirements when collecting, using, or processing this type of sensitive data. Working Hours and Salaries for Roster Shifts

It has been more than three years since the Revised Labour Law (Labour Law) came into force. For the first time, Labour Law provided detailed regulations for “roster shifts". According to Article 92.3 of the Labour Law, “For roster shift employees, the working day shall not last more than 12 hours, and overtime pay shall be calculated and paid based on Article 109.1 in accordance with Article 87. This article has created uncertainty in the application of the law and created a discrepancy between employees and employers as to how normal working hours were determined.

The Supreme Court of Mongolia’s Interpretation of Cartel Principles and Contractual Freedom

The main purpose of Сompetition law is to protect against unfair competition and to prevent, prohibit, and restrict any activities that are detrimental to fair competition. Unfair competition may manifest in various forms, one of which is anti-competitive agreements or arrangements (cartels). Consequently, the legal framework governing fair competition imposes prohibitions and restrictions on such agreements and arrangements.
