Status of File as of May 23, 2024

On May 3, 2024, the Court issued an order (the “Bankruptcy Order”), which, among other things, authorized PricewaterhouseCoopers Inc., LIT (“PwC”), in its capacity as Receiver to assign 2563773 Ontario Inc. (the “Company”) into bankruptcy.

On May 17, 2024, pursuant to the provisions of the Bankruptcy and Insolvency Act (Canada) (“BIA”) and the Bankruptcy Order, the Company was assigned into bankruptcy and PwC was appointed as licensed insolvency trustee (the “Trustee”) of the bankrupt estate of the Company by the official receiver, subject to affirmation by the creditors of the Trustee's appointment or substitution of another trustee by the creditors.

On May 23, 2024 the Notice of Bankruptcy and the First Meeting of Creditors was issued to all known creditors of the Company in accordance with the provisions of the BIA.

Status of file as of August 22, 2023

On August 18, 2023 (the “Date of Appointment”), pursuant to an order (the “Receivership Order”) of the Ontario Superior Court of Justice Commercial List (the “Court”), PricewaterhouseCoopers Inc., LIT (“PwC”) was appointed as receiver and manager (the “Receiver”), without security, of all of the assets, undertakings and properties (the “Property”) of 2563773 Ontario Inc. (the “Company”) acquired for, or used in relation to a business carried on by the Company, pursuant to section 243(1) of the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3, as amended (the “BIA”) and section 101 of the Courts of Justice Act, R.S.O. 1990, c. C.43, as amended.

The Receivership Order was granted pursuant to an application made by Canadian Western Bank (“CWB” or the Applicant”).

In accordance with the provisions of the BIA, a Notice and Statement of the Receiver (the “Notice”) was sent to all known creditors of the Company on August 31, 2023. A copy of the Notice is posted on the “Notices” page of this website.
