Status of file as of December 3, 2024

On November 29, 2024, the Superior Court of Quebec issued an Amended and Restated Initial Order extending the stay period against the Debtors until December 20, 2024.

Status of file as of November 27, 2024

On November 15, 2024, the Secured Creditor EDC, in collaboration with the Debtors, filed a petition for continuance of the Bankruptcy and Insolvency Act proceedings under the Companies’ Creditors Arrangement Act (“CCAA”). The Superior Court of Québec granted the petition and issued an Initial Order pursuant to the CCAA on November 21, 2024 (the “Initial Order”). The Initial Order adds to the procedures the related entities Bus.com US Holding Inc., Bus.com Leasing LLC, Bus.com US LLC and 9139249 Canada Inc. (California) (collectively with 9139249 Canada Inc., the « Debtors »).

The Initial Order provides for an initial stay of all proceedings until November 29, 2024 and appoints PricewaterhouseCoopers Inc. (Christian Bourque, FCPA, CIRP, LIT) (the “Monitor”) as monitor of the business and financial affairs of the Debtors.

Status of file as of October 16, 2024

On October 11, 2024, following the filing of a motion by the Debtor, the Superior Court of Quebec issued an order:

  • extending the delay to file a proposal and the Stay Period to November 25, 2024;
  • approving the increase in the amount of interim financing and other related relief

Status of file as of August 19, 2024

On August 19, 2024, following the filing of a motion by the Debtor, the Superior Court of Quebec issued an order:

  • extending the delay to file a proposal and the Stay Period to October 14, 2024;
  • approving an interim financing and other related relief

On the same date, a second order was issued by the Superior Court of Quebec authorizing a sale and investment solicitation process.

Status of file as of August 13, 2024 

9139249 Canada Inc. (the "Debtor") has filed with the Official Receiver a “Notice of Intention to Make a Proposal” pursuant to Subsection 50.4(1) of the Bankruptcy and Insolvency Act on the 9th day of August 2024.

Pursuant to Section 69 of the Bankruptcy and Insolvency Act, all proceedings against the Debtor are stayed as of the date of filing the Notice of Intention to Make a Proposal with the Official Receiver. 

A letter addressed to creditors is available in the "Notice to creditors" section.
