Status of File as of July 10, 2020

On July 10, 2020, the Receiver filed its Third Report to the Court in support of an application with respect of the granting of security by Devlin to PBR&R Holdings, Devlin's landlord, just prior to the NOI proceedings. The application is scheduled to be heard on September 8, 2020

Status of File as of September 11, 2019 

On September 11, 2019, the Court granted an Interim Distribution Order in respect of a proposed distribution of funds held by the Receiver to certain secured creditors. A copy of this order is posted in the Court Orders section of this website.

Status of file as of August 29, 2019 

On August 29, 2019, the Receiver filed its Second Report to the Court seeking, among other things, approval of a proposed distribution of the Maynards auction proceeds to certain secured creditors. The hearing is scheduled for September 11, 2019. A copy of the Second Report and application materials can be found in the Court Reports and Application Materials sections.

Status of File as of May 13, 2019 

On May 13, 2019, the Court granted an Approval and Vesting Order in respect of the sale of Devlin's assets by way of auction. A copy of this order is posted in the Court Orders section of this website.

Status of file as of May 6, 2019 

On May 6, 2019, the Receiver filed its First Report to the Court seeking, among other things, approval of the sale of Devlin's assets by way of auction. The hearing is scheduled for May 13, 2019. A copy of the First Report and application materials can be found in the Court Reports and Application Materials sections.

Status of file as of April 8, 2019

On February 7, 2019, Devlin Construction Ltd. ("Devlin") and S7 Ventures Ltd. ("S7")(collectively referred to as the "NOI Companies") filed a Notice of Intention to Make a Proposal ("NOI") under subsection 50.4(1) of the Bankruptcy and Insolvency Act. Subsequently, on March 6, 2019, the NOI Companies applied for and received an Order extending the time to file a Proposal to April 8, 2019. 

On April 8, 2019, Devlin and S7 applied for an Order extending the time to file a Proposal. The Order was not granted, and the NOI Companies did not file a Proposal to their creditors. As a result of the foregoing, the NOI Companies were deemed bankrupt.

On April 8, 2019, PricewaterhouseCoopers Inc., LIT was appointed Receiver of Devlin Construction Ltd., S7 Ventures Ltd. and KMOJ Holdings Ltd. ("KMOJ") by the Court of Queen's Bench of Alberta ("Receivership Order"). A copy of the Receivership Order can be accessed under the Court Orders tab of this website.
